Securitization Audit Could Save You From Foreclosure
The most powerful tool to help save your home in the event you are being foreclosed on may very well be a securitization audit or examination. A securitization audit is a type of mortgage loan, forensic audit that tracks the paper trail of the note attached to your property. For more than 90% of the loans that were masde after about 2005, there is a high likelyhood that they were sold into trust pools and "securitized". Securitization is what happens to the loan note (I use the word "loan" very loosely") when it is put into the trust and converted from a negotiable, colateralized, instrument, into a stock certificate or equivalent. Once the note has been converted it has been forever severed from the deed of trust, rendering the deed of trust unenforceable. The note cannot exist as a negotiable instrument and a certificate at the same time.

Once your loan has been verified to be within a particular trust, the 424B-5 Prospectus and Pooling and Servicing Agreement (PSA) which are the documents that govern the trust, can be pulled and examined. With this information, most people will have ample evidence and indeed, proof positive that the foreclosing party has no standing and is not a party of interest. It is the prospectus and the PSA that are really the damning evidence against the bank, and proves that they have committed numerous counts of fraud.

If you are mounting a defense to protect yourself from foreclosure, you will definitely want to do a securitization audit as the crux of your case. You will need to make sure that you have an expert who has been certified to to such an audit and who is qualified to testify in court if needbe.
